This is the reference version of the Terms of Use.

General provisions

These Terms of Use govern access to and use of the anywhere-app.com website as well as the services of the Anywhere ecosystem. The commercial terms — subscription, pricing, duration and termination — are governed by the Terms and Conditions of Sale.

The terms "Client", "User", "Traveller" and "Services" used herein have the meaning defined in the Terms and Conditions of Sale.

This website is the property of LIVING PARISIAN INVESTORS & RESIDENCES, an EURL with a share capital of €527,900, registered with the Nanterre Trade and Companies Register under number 804 662 716, intra-Community VAT number FR 85 804662716, with its registered office in Boulogne-Billancourt (92100), hereinafter referred to as "LIVING PARISIAN INVESTORS & RESIDENCES".
The publication director of the website is Alexis Rodrigues, in his capacity as manager of LIVING PARISIAN INVESTORS & RESIDENCES.

The website is hosted by OVH SAS, 2 rue Kellermann, 59100 Roubaix, France, telephone: +33 9 72 10 10 07. The data is hosted in France.

The information contained on the website is provided for information purposes. For any technical request, the user is invited to write to contact@anywhere-app.com.

By connecting to the website, the user acknowledges having read and accepted these Terms of Use in their entirety, and accepts that their personal information may be collected, used or transmitted under the conditions set out below.

These Terms of Use are those in force at this date. LIVING PARISIAN INVESTORS & RESIDENCES may amend them as often as necessary. Users who do not accept the Terms of Use must not use the website under any circumstances.

This website is governed by French law. Conflict-of-law rules are expressly excluded in favour of the full and unreserved application of French law. Foreign residents formally accept the application of French law by visiting this website and using all or part of its features.

Any dispute relating to the interpretation or performance of the Terms of Use that cannot be resolved amicably shall fall within the exclusive jurisdiction of the Commercial Court of Nanterre. In all cases, this clause shall apply alone, even in the event of summary proceedings, a warranty claim or multiple defendants.

Account and access

Access to the services requires the creation of a dedicated environment for the Client. Login credentials are strictly personal and confidential. The Client is responsible for keeping them secure and for any activity carried out from their account.

The Client may grant access to their environment to several users; they remain responsible for the rights they assign to them and for their actions. The Client undertakes to report any unauthorised use of their credentials to LIVING PARISIAN INVESTORS & RESIDENCES without delay.

LIVING PARISIAN INVESTORS & RESIDENCES may suspend or close an access in the event of a breach of these terms, under the conditions set out in the Terms and Conditions of Sale.

Use of the website and services

The user undertakes to use the website and the services in accordance with their intended purpose and with applicable regulations.

The following are notably prohibited: the automated or large-scale extraction of data, reverse engineering, any attempt to gain unauthorised access to the systems, any action intended to disrupt the operation or security of the website and services, and the distribution of unlawful content.

Client's legal obligations

The Client remains solely responsible for complying with the legal obligations attached to its short-term rental activity, in particular keeping the individual police registration form (fiche individuelle de police) for the travellers concerned, collecting and remitting the tourist tax (taxe de séjour), and any obligations to declare or register furnished tourist accommodation (meublé de tourisme).

The services facilitate the fulfilment of some of these obligations but do not replace them. The Client deals with their compliance as its own responsibility.

Intellectual property

LIVING PARISIAN INVESTORS & RESIDENCES retains all of its intellectual property rights over its own data. Every user undertakes to respect all of the rights of LIVING PARISIAN INVESTORS & RESIDENCES over its trademarks and other distinctive signs.

Any use, duplication, representation or disclosure, in whole or in part, of this website or of one or more of its components, by any means whatsoever, without the express authorisation of LIVING PARISIAN INVESTORS & RESIDENCES or of the relevant third-party holders, is prohibited and would constitute an infringement liable to legal proceedings.

This clause concerns the website and its content. The rights relating to the software of the Anywhere ecosystem and their conditions of use are set out in the Terms and Conditions of Sale.

Links to and from other websites

The hyperlinks placed on our website in no way engage the liability of LIVING PARISIAN INVESTORS & RESIDENCES. These websites are independent and LIVING PARISIAN INVESTORS & RESIDENCES may not under any circumstances be held responsible for their content, availability, relevance or otherwise.

Translation

Certain texts available on the website, and in particular the Terms of Use, are provided for convenience in languages other than French. These translations may not engage the liability of LIVING PARISIAN INVESTORS & RESIDENCES; only the French version is authoritative.

Personal data

The processing of personal data carried out from the website is performed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the amended French Data Protection Act of 6 January 1978 (loi n° 78-17). LIVING PARISIAN INVESTORS & RESIDENCES is the controller of the processing carried out in connection with the management of the website and its services.

Purposes and legal bases

Data is processed for the following purposes: managing the account and providing the services (performance of the contract); invoicing and compliance with accounting obligations (legal obligation); support and customer relations (legitimate interest); website audience measurement (consent); the prevention of abusive use and fraud (legitimate interest); and, for the Online Check-in extension, preparing travellers' arrival and completing the individual police registration form on behalf of the Client.

Retention periods

Data is retained for the following periods:

  • Account and Client data: for the duration of the contract, then deleted within 90 days of its termination, unless a legal obligation requires otherwise.
  • Invoicing data: 10 years, in accordance with accounting obligations.
  • Travellers' booking data: for the duration of the contract.
  • Identity documents collected during check-in: automatically deleted 30 days after they are uploaded.
  • Connection logs and IP addresses: 12 months.
  • Audience measurement cookies: 13 months maximum.
  • Commercial prospecting data: 3 years from the last contact.

Recipients and processors

To provide its services, LIVING PARISIAN INVESTORS & RESIDENCES uses technical providers that process certain data on its behalf: OVH (hosting, in France), Stripe (payments), Google (secure e-mail sending), Google Analytics (audience measurement) and Google reCAPTCHA (protection against abusive use). These providers only access the data to the extent strictly necessary for their service.

Transfers outside the European Union

Certain providers, in particular Google (audience measurement, anti-abuse protection and e-mail sending), may process data from countries located outside the European Union, including the United States. These transfers are governed by appropriate safeguards within the meaning of the GDPR, such as the European Commission's standard contractual clauses or recognised certification mechanisms.

Security

LIVING PARISIAN INVESTORS & RESIDENCES implements technical and organisational measures designed to protect data: hosting in France, encryption of sensitive files and restriction of access to authorised persons only.

LIVING PARISIAN INVESTORS & RESIDENCES may use the user's IP address, in cooperation with its host, to enforce these Terms of Use, protect its services and its clients, or respond to a request from the judicial authorities.

Your rights

In accordance with applicable regulations, the user has the right to access, rectify, erase, restrict, object to and port their data. These rights may be exercised by writing to contact@anywhere-app.com. The user also has the right to lodge a complaint with the CNIL (the French data protection authority).

Reversibility

The Client may export their data from their environment throughout the duration of the contract. At the end of the contract, their data is deleted within the periods indicated above, subject to legal retention obligations.

Online check-in specifics

The online registration system of LIVING PARISIAN INVESTORS & RESIDENCES allows the host to prepare travellers' arrival. Depending on how the system is configured by the hosts, travellers may be asked for personal information.

The identity verification step of the online registration system provides hosts with a safeguard against identity fraud and allows the individual police registration form to be completed in advance. This identity verification step may be configured by hosts to request surname, first name, date of birth, nationality, address, a photograph of an identity document and a selfie of the person who made the booking. During this step, travellers are informed that they may contact their hosts, who may, depending on the circumstances and on alternative checks, waive the requirement.

As the images provided in this context are sensitive data, they are automatically and systematically deleted 30 days after they are uploaded. The files are stored in encrypted and secure form on servers located in France, with an expiry feature triggering their automatic deletion. During the retention period, only the hosts of the accommodation can access the content of the files via an encryption key known to them alone. LIVING PARISIAN INVESTORS & RESIDENCES can access the encrypted files but not their content.

Cookies

While browsing, cookies and trackers may be stored on the user's device. There are three categories:

  • strictly necessary cookies, essential to the operation and security of the site (session management, abuse protection via Google reCAPTCHA); they do not require consent;
  • functional cookies, set by third-party services such as the support chat (Crisp), used to provide certain features of the site;
  • audience-measurement cookies, set via Google Tag Manager and Google Analytics 4, used to understand how the site is used; they are only set after consent.

On the first visit, a consent banner is displayed. Audience-measurement cookies are set only after the user has accepted. The user can accept all, refuse all, or choose by category; strictly necessary cookies remain active, as they are essential to the operation of the site.

The choice is kept for six months, after which the user is asked again. The user can change or withdraw consent at any time via the “Manage cookies” link at the bottom of every page. Refusing non-essential cookies does not prevent access to the site. Audience-measurement data is processed by Google; the applicable safeguards, in particular for transfers outside the European Union, are set out in the “Personal data” section and in Google's privacy policy.

Use of Google OAuth 2.0 for sending e-mails

LIVING PARISIAN INVESTORS & RESIDENCES uses the Google OAuth 2.0 protocol for authentication and the secure sending of e-mails via Gmail addresses, in accordance with Google's security standards and requirements.

When sending electronic communications (notifications, booking confirmations, transactional messages), LIVING PARISIAN INVESTORS & RESIDENCES may use Gmail accounts configured with the OAuth 2.0 protocol. This authentication method ensures a high level of security by using temporary access tokens rather than passwords, in accordance with Google's recommendations for third-party applications.

The use of Google OAuth 2.0 involves:

  • Secure authentication via Google's servers without storing passwords in plain text
  • Compliance with the quotas and limitations imposed by the Google Mail API to ensure service quality
  • Compliance with the usage policies of Google Workspace and the Gmail API
  • Encryption of communications between our servers and Google's servers
  • Compliance with anti-spam standards (SPF, DKIM, DMARC) to ensure message deliverability

Data transmitted via this protocol is processed in accordance with Google's privacy policy and these Terms of Use. LIVING PARISIAN INVESTORS & RESIDENCES undertakes to use these services only for sending legitimate communications related to the use of its services.

Data accessed

The application accesses the following types of Google user data via the following OAuth scopes: 'openid' (for open authentication), 'email' (e-mail address), 'profile' (basic profile information), and 'https://www.googleapis.com/auth/gmail.send' (authorisation to send e-mails via Gmail).

Use of data

The 'openid', 'email' and 'profile' scopes are used solely to validate the authentication of the user's account and are not used elsewhere in the application. The 'https://www.googleapis.com/auth/gmail.send' scope is used to send notifications relating to the travel process, such as booking confirmations, messages and e-mails scheduled by the user, as well as for the management of the platform by administrator users, in accordance with Google's policies.

Miscellaneous provisions

If any of these provisions were to be declared null or unenforceable, the remaining provisions would retain their full force.

The failure of LIVING PARISIAN INVESTORS & RESIDENCES to rely on a breach of any of these provisions shall not constitute a waiver of its right to rely on it subsequently.

These Terms of Use, together with the Terms and Conditions of Sale, express the entire agreement relating to the use of the website and services.
